Terms and Conditions for Members
1. Definitions
1.1. Reference to 'artist' includes an individual engaged in the creation of a form of creative output, such as paintings, sculpture, photography, performance, objet d'art, ornamental work, couture, jewels and accessories.
1.2. Reference to 'works' or 'artworks' includes all forms of creative output delivered by an artist or designer
2. Copyright Ownership
2.1. THE GAZE exclusively owns the copyright to all content including features, banners, or blog articles produced or published by THE GAZE.
2.2. Members who contribute content to THE GAZE retain their individual copyright ownership of their original works. However, by submitting artworks for publishing, members grant THE GAZE a non-exclusive license to:
* Display and publish the artworks in THE GAZE online magazine.
* Share these artworks on social media accounts connected to THE GAZE.
2.3. Members must ensure that they either own the copyright to the submitted artworks or have obtained permission from the copyright holder to submit them.
3. Artwork Subject Matter
3.1. Artworks submitted to THE GAZE must not include pornographic, violent, or racist material. If any submitted artworks violate this criterion, THE GAZE reserves the right to withdraw the submission.
4. Content Sharing
4.1. Content published in THE GAZE may be shared digitally on other platforms via linking to THE GAZE online magazine. However, members must ensure that proper attribution to THE GAZE copyright is provided when sharing.
4.2. Unauthorised copying or reproduction of content from THE GAZE constitutes a direct breach of copyright.
5. Removal of Artworks
5.1. Members may request the removal of their artworks from, THE GAZE website, or social media at any time. THE GAZE will promptly comply with such requests but reserves the right to request a replacement image should the removal impact the integrity of the article or content related to the artist's work.
5.2. Please note that if third parties, including educational institutions or individuals, download and save information and images from THE GAZE website or other platforms. THE GAZE cannot control or accept responsibility for any subsequent use by third parties.
6. Membership Renewals and Fees
6.1. Membership renews automatically each year. Customers may cancel any time after the initial 12‑month term. Cancellations received after the renewal date will take effect at the next annual anniversary.6.2. THE GAZE retains the sole discretion to annually review and adjust Membership fees by a maximum of 5%.
7. Expenses
7.1.All reasonable expenses, including any travel outside Basel for the purpose of the feature, will be chargeable to the client.
